Who we are & scope. Pinch, Inc. (“Pinch,” “we,” “us”) operates pinchmagic.com and related pages (the “Site”). This Privacy Statement explains how we collect, use, disclose, and protect personal information in connection with the Site, our products, and customer support.
SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?
When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing: With your permission, we may send you emails about our store, new products and other updates.
Information from visiting the Service’s Site may also be collected, something commonly used by organizations to learn more about their customers, including information relating to the system, operating system, location, IP address, browser type, browser version, pages visited, the date and time of your visit, time spent on pages, or other information identified by cookies, pixels, session replay tools, and analytics services (including but not limited to Meta Pixel ("Meta"), Google Analytics ("Google"), Recharge, Klaviyo, Triple Whale, etc.). These technologies may capture information about your interactions with our website, including clicks, keystrokes, and browsing activity. Google Analytics also uses “Cookies”, text files that are saved on the hard drive of your computer and enable the analysis of website use through you. The information gathered by the cookie about the use of this website will generally be transmitted to Google servers in the US and saved there. As licensed by the owners of this website, Google will use this information in order to analyze your use of this website, in order to compile reports regarding the website activity, and in order to render further services associated with website activity and internet usage to the owner of this website. The IP address of your browser as detected by Google Analytics will not be conflated with other data from Google. By using this website, you are consenting to the appropriation of data about you by Google in the manner and for the purposes laid out above.
We may monitor, log, and store communications with our website, including chat or support requests, for quality assurance and security.
Personal data may be shared with third parties for advertising and analytics purposes, including payment processors, shipping partners, marketing providers, and fraud prevention tools.
We may disclose Information as required by law, such as to comply with a subpoena, or similar legal process:
- When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
- With our trusted services providers who work on our behalf, who do not have an independent use of the information we disclose to them, and whom have agreed to adhere to the rules set forth in this privacy statement;
- In aggregate and/or in the form of trends or insights on our blog or other places online without personally identifying information included;
- If Pinch, Inc. is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of this information, as well as any choices you may have regarding this information.
SECTION 1A – SALE/SHARE & TARGETED ADVERTISING (CALIFORNIA)
We do not sell personal information for money. We do “share” personal information (as defined by California law) for cross-context behavioral advertising with advertising/analytics partners (e.g., Meta, Google, Klaviyo, Triple Whale). Categories potentially shared: Identifiers, Internet/Network activity, Inferences/segments. You can opt out at any time (see Your Privacy Choices below). We do not knowingly sell/share personal information about children under 16.
SECTION 2 - CONSENT
How do you get my consent?
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.
By visiting our website or other digital properties, we may collect and/or pass along personal information to 3rd party partners for marketing, website, or business performance reasons, such as cookies or IP addresses. This is standard practice for online businesses. By using our site, you consent to our use of cookies and tracking technologies.
How do I withdraw my consent?
If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at hello@pinchmagic.com. Further, you can:
- Adjust cookie/advertising preferences via your browser settings or device ad settings.
- Use Global Privacy Control (GPC) signals - we honor GPC for California opt-out.
Your California Privacy Rights. If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA), as amended by the CPRA. These include:
- Right to Know what personal information we collect, use, disclose, or share.
- Right to Delete personal information we hold about you (with certain exceptions, like completing orders or legal obligations).
- Right to Correct inaccurate personal information.
- Right to Opt-Out of Sale or Sharing of your personal information. While we do not sell data for money, we may share information with advertising, analytics, and marketing partners, which California law may treat as a “sale” or “share.”
- Right to Limit Use of Sensitive Personal Information to only what is necessary to provide our services.
To make a request, email us at hello@pinchmagic.com with the subject line “California Privacy Rights Request” to exercise your CPRA rights (know, delete, correct, opt-out of sale/share, limit use of sensitive information). Include your name, email address, and details of your request so we can verify your identity.
Authorized agents. California residents may use an authorized agent; we will verify both the agent and the request.
SECTION 3 - DISCLOSURE
We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
SECTION 4 - SHOPIFY
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.
Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - THIRD-PARTY SERVICES
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.
In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.
Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.
Links. When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.
Service providers vs. third parties. Some vendors act as our service providers/processors and may only use personal information to perform services for us under contract (e.g., Shopify, payment processors, shipping carriers, fraud prevention). Others (e.g., analytics/advertising partners) may act as independent businesses with their own privacy notices. See Section 1A for our sale/share disclosures.
SECTION 6 - SECURITY
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.
If we determine that a data incident creates a risk of harm, we will provide notifications as required by applicable law.
SECTION 7 – COOKIES & SIMILAR TECHNOLOGIES
We use:
- Essential (site operation, cart, checkout, security);
- Performance/Analytics (to measure and improve the Site);
- Advertising (to show relevant ads and limit repeats);
- Functional (preferences).
You can control cookies via your browser, OS-level settings, or GPC. Blocking some cookies may affect the Site’s functionality.
SECTION 8 - AGE OF CONSENT
By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
SECTION 9 - CHANGES TO THIS PRIVACY POLICY
We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
